Terms of use
These terms apply to your use of SpotOn – Spotlight Director ("SpotOn"), a Zoom App, and the website spoton.nvcrising.org. SpotOn is provided by Global Rising GbR, Vaubanallee 2, 79100 Freiburg, Germany ("we", "us"). By adding or using SpotOn you agree to these terms.
1. The service
SpotOn helps hosts and co-hosts of Zoom meetings and webinars manage Zoom's spotlight: putting people on stage, keeping them there, queuing and timing speakers, and saving layouts. It works through the Zoom Apps SDK inside the Zoom client, and it can only do what Zoom allows the person using it to do.
SpotOn is currently free of charge. If we ever introduce paid features, we will tell you in advance, and nothing will be charged without your explicit agreement.
2. Your right to use SpotOn
We grant you a free, non-exclusive, non-transferable right to use SpotOn for its intended purpose while these terms apply. You may not copy, resell, reverse-engineer or interfere with the service, or use it in a way that breaks the law or Zoom's terms.
3. Zoom
SpotOn runs inside Zoom, and your use of Zoom is governed by your agreement with Zoom Video Communications, Inc. SpotOn is not made, endorsed or supported by Zoom. Zoom's rules and limits apply to SpotOn too. For example, spotlight needs at least three participants with video on, allows at most nine people, and may be restricted for co-hosts. If Zoom changes or withdraws a feature SpotOn relies on, parts of SpotOn may stop working.
4. Using SpotOn responsibly
- Use SpotOn only in meetings and webinars you are entitled to host or co-host.
- Respect your participants. You decide who is shown on stage, and you are responsible for doing so lawfully and fairly. If you post chat announcements, they appear under your name.
- Don't use SpotOn to harass, expose or mislead anyone, or to send unsolicited advertising.
5. Privacy
How SpotOn handles data is described in our privacy policy. In short, meeting data stays on your computer and is not stored on our servers.
6. Availability and changes
We work to keep SpotOn available and useful, but we cannot promise uninterrupted operation. We may improve, change or discontinue features. If we plan to discontinue SpotOn altogether, we will announce it on this website in reasonable time.
7. Liability
SpotOn is provided free of charge. We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, and under the German Product Liability Act. Beyond that, and to the extent the law allows, we are not liable for damage caused by slight negligence. Nothing in these terms limits rights that consumers have under the mandatory law of the country where they live.
8. Ending use
You can stop using SpotOn at any time by removing it from your Zoom account (see the user guide). We may suspend access for anyone who seriously or repeatedly breaks these terms.
9. Changes to these terms
We may update these terms, for example when the service or the law changes. The date at the top shows the current version. If a change significantly affects you, we will point it out on the website before it takes effect. If you keep using SpotOn after a change takes effect, the new terms apply.
10. Governing law
These terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you keep the protection of the mandatory rules of the country where you usually live. If you are a merchant, the courts at our place of business have jurisdiction.
